Terms of Service for the Preferred Provider Medical & Health Member Program

PROGRAM PARTICIPATION:

Please read this Preferred Provider Medical & Health Member Subscriber Agreement carefully before registering as a Preferred Provider Medical & Health Member/Subscriber. In order to participate in our Preferred Provider Medical & Health Subscriber Program, you must agree and abide by the terms and conditions of this Agreement. By signing up as a Preferred Provider Medical & Health Member, you are in acceptance of this Preferred Provider Medical & Health Member Subscriber Agreement in its entirety.

WSIBSETTLEMENTS has the right to change, modify or remove any portion of this Preferred Provider Medical & Health Member Subscriber Agreement as well as change, suspend or discontinue any aspect of our services. You will be notified by e-mail prior to any material change.

You also consent to the collection and use of your personal information in accordance with the Privacy Statement. WSIBSETTLEMENTS has the final authority as to the interpretation of this Preferred Provider Medical & Health Member Subscriber Agreement. 

AGREEMENT MODIFICATION:
WSIBSETTLEMENTS reserves the right to modify this Preferred Provider Medical & Health Member Subscriber Agreement at our sole discretion. You will be notified by email of any material change. You may then agree to these changes or withdraw from the Preferred Provider Medical & Health Member Subscriber Program.  

MISPRINTS, CHANGES, AND ERRORS:
WSIBSETTLEMENTS reserves the right to; a) change the products and services advertised on the site, and promotional offers, or other site material at any time without notice or liability to you or any other person; b) cannot guarantee that products and services advertised for sale will be available when ordered or thereafter; c) limit quantities sold; d) not warrant that the site materials are accurate, complete, reliable, current or error-free; e) cancel, terminate or not process an order (including accepted orders) where the price or other material information on the site is inaccurate.  In the event that we do not process an order for one of the above-listed reasons, you will be advised of the order cancellation and will either not be charged, or a credit will be applied to the type of payment used in the order.

INTELLECTUAL PROPERTY:
All images, technology, content, trademarks, banner and intellectual property, copyrights, patent rights, applications, and trade names shall remain the sole property of WSIBSETTLEMENTS.  None of these materials may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means without prior written permission of WSIBSETTELMENTS.

REPRESENTATIONS:
WSIBSETTLEMENTS makes no representations or warranties about any website which you may access through wsibsettlements.com.  WSIBSETTLEMENTS does not endorse or accept responsibility for the content or use of any website, or the accuracy of any offers made by third parties, or that any third party will honor any such offers, coupons, rebates, discounts, etc. posted at wsibsettlements.com. WSIBSETTLEMENTS is not responsible for providing any value for these.

ENROLLMENT:
The Preferred Provider Medical & Health Member Subscriber Program is exclusive to businesses that provide medical and health care services consisting of Dental, Massage Therapy, Chiropractic, Personal Training, Acupuncture, Health Food Products. Enrollment is in the business legal name or personal legal name of the principal owner of the business providing said services.

To participate in the Preferred Provider Medical & Health Member Subscriber Program, you must have a valid mailing address and valid e-mail address.

Enrollment in the program is completed when you complete the Registration Form and purchase your 12-month subscription program.

A Preferred Provider Medical & Health Member Subscriber is responsible for advising WSIBSETTLEMENTS of any change in their name, mailing address, e-mail address, or any other required enrollment information.

Any discounts and/or promotions being provided by the Preferred Provider Medical & Health Member Subscriber is at the discretion of the Preferred Provider Medical & Health Member Subscriber and void of any obligation by WSIBSETTLEMENTS to provide and/or fulfill said promotions. Any violation of this rule will be void and may result in the loss of membership.

By becoming a Preferred Provider Medical & Health Member Subscriber, you consent to receive e-mail and/or mailing communications regarding our services and other programs.

LIMITATION OF LIABILITY:
WSIBSETTLEMENTS assumes no liability whatsoever, including without limitation, liability for any expense, loss, cost, injury, damage, accident, or any other matter or thing whatsoever, however, suffered or caused (including compensatory, incidental, indirect, special, punitive, consequential or exemplary damages for loss of income or profits), directly or indirectly arising out of or related to the Preferred Provider Medical & Health Member Subscriber Program or by reason of the termination of or amendment to the Preferred Provider Medical & Health Member Subscriber Program in whole or in part, with or without notice.

WSIBSETTLEMENTS is not responsible for any failure of their website or for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail, online, or Internet entry. Also, WSIBSETTLEMENTS is not responsible due to technical problems, traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to any computer or property related to or resulting from participating in or downloading any material relating to the Preferred Provider Medical & Health Member Subscriber Program. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Preferred Provider Medical & Health Member Subscriber Program is a violation of criminal and civil laws, and should such an attempt be made, WSIBSETTLEMENTS reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.  

FORCE MAJEURE:
Neither party shall be liable hereunder by reason of any failure or delay in the performance of its obligations hereunder on account of strikes, shortages, riots, insurrection, fires, flood, storm, explosions, acts of God, war, governmental action, labor conditions, earthquakes or any other cause which is beyond the reasonable control of such party.

JURISDICTIONAL ISSUES:
This Preferred Provider Medical & Health Member Subscriber Program Agreement shall be governed by the Province of Ontario, and the federal laws of Canada.  The exclusive forum for any actions brought in connection with this Preferred Provider Medical & Health Member Subscriber Program Agreement shall be in the provincial and federal courts for the Province of Ontario and all parties consent to this jurisdiction.
