Understanding the WSIB Appeal Process
The Workplace Safety and Insurance Act provides both employers and workers covered by the statute with the right to appeal decisions made by WSIB staff.
There are specific appeal procedures that workplace parties must follow when objecting to a WSIB decision.
The following provides the basic steps required to initiate an appeal and the different stages of the process.
To help injured and ill workers understand the WSIB appeal process, WSIB Settlements has compiled the following WSIB Appeal Flow Process.
IMPORTANT: This only applies to appeals of decisions made by WSIB front-line decision-makers, such as Case Managers and Eligibility Adjudicators, that make their way through to the WSIB’s first and final level of appeal at the Appeals Services Division. These appeals are dealt with by Appeals Resolution Officers (ARO). For assistance in appealing a WSIB Appeals Resolution Officer decision to the external Workplace Safety and Insurance Appeals Tribunal (WSIAT), don't hesitate to contact our Specialized Member Services Team, and they will be able to help you.
