Please follow the instructions below to activate your membership and start the process. Once you have activated your membership, we will obtain a copy of your WSIB claim file. This will help us perform the audit and develop a plan to ensure all issues are addressed, your rights are protected, and you can make informed decisions.
How it works...
Case Audit
We conduct an in-depth review of your case, including your WSIB claim file, to identify any issues that were not properly handled by the WSIB and entitlement to benefits that the WSIB did not consider. This becomes a road map for all actions required to address your issues and gain entitlement to benefits.
Prepared Submissions
We know appeals take a long time: months, even years. We try to avoid that whenever possible. We draft a formal request for a reconsideration of decisions we do not believe were appropriate by WSIB decision-makers, and make a formal request for benefits and services the WSIB failed to address in your claim. They're not just a request for benefits without support. Much like when preparing a case for a hearing, we draft submissions that reference any applicable legislation and policy that supports your case, and whenever possible, we include Tribunal jurisprudence where the Workplace Safety & Insurance Appeals Tribunal (WSIAT) has rendered positive decisions for the worker in similar cases as yours, we also reference Tribunal Medical Discussions Papers that deal with similar medical issues as yours. These are documents that the Tribunal has requested from experts with expertise in various medical conditions to help the Tribunal make decisions.
Legal Referral to Preferred Legal Provider
In some cases, proceeding with a formal appeal is the more appropriate route. We will be able to identify that quickly and, with your permission, will proceed with a Legal Referral to one of our experienced lawyers or paralegals on our Preferred Legal Provider Network so that they can proceed on your behalf. There are many benefits to having one of our PLP handle your case. For starters, we have already done the vetting for you and know they are the best at what they do. Secondly and equally important, they provide our members with preferred rates to handle their appeals. This means you get to keep more of your settlement in your pocket!
Fees
We know the strain a WSIB claim can have on your finances. For this reason, we have a two-tiered Fee Structure. The first tier covers the Case Audit and Prepared Submission. As noted below, this can be paid one-time or in three equal monthly payments.
- You can make a one-time payment of $500 and save $100.
- You can pay in three equal payments of $200 each.
Payments can be made by credit/debit card or by e-transfer
Our Contingency Fee Agreement covers the second-tier fees. A Contingency Fee Agreement means that any additional fees will apply only if we successfully gain additional benefits for you. If we are unsuccessful, you won't be charged any extra fee. You can view our agreement below. You will note that our fee for securing benefits and services for you through reconsideration submissions and without a formal appeal is significantly less than what it would be if a formal appeal were required.
