The following describes the Free Case Assessment
Assessment Stage
First, we will have one of our experts conduct an in-depth review of your case, including your WSIB claim file, to identify any issues not correctly handled by the WSIB and benefits that were not considered in your claim. But we don't stop there...
During the Assessment
While we conduct the assessment, we will also prepare draft submissions to address any issues we identify that the WSIB did not adequately consider, and we will discuss them with you. In most cases, our submissions can be uploaded to the WSIB right away to avoid delays in resolving your issues.
Our submissions may be a formal request for the WSIB to reconsider prior decisions we believe were not appropriate by WSIB decision-makers, including requests for benefits and services that the WSIB failed to address in your claim. These documents are not just a request for benefits or for the WSIB to review what they had already reviewed when making the initial decision, without the kind of support that could result in a favourable decision. The draft submissions will reference any applicable legislation and policies supporting your case. Whenever possible, we include Tribunal jurisprudence where the Workplace Safety & Insurance Appeals Tribunal (WSIAT) has rendered positive decisions for workers in similar cases to yours; we also reference Tribunal Medical Discussions Papers that address similar medical issues. These are documents the Tribunal has requested from experts in various medical conditions to help it make decisions.

Email us a copy of your WSIB file as soon as you receive it so that we can get started. Performing our review and preparing submissions generally takes a few days.
