Case Audit

Should you decide to activate your membership by following the process below, we will obtain a copy of your WSIB claim file. We then conduct an in-depth review of your case, including your WSIB claim file, to identify any issues not correctly handled by the WSIB and benefits that the WSIB did not consider in your claim. This becomes a road map for all actions required to address your issues and gain entitlement to benefits.

Prepared Submissions

We know appeals take a long time: months, even years. We avoid that whenever possible. We draft a formal request for a reconsideration of decisions we do not believe were appropriate by WSIB decision-makers, and make a formal request for benefits and services the WSIB failed to address in your claim. These documents are not just a request for benefits or for the WSIB to review what they had already reviewed when making the initial decision, without the kind of support that could result in a favourable decision. Much like when preparing a case for a hearing, we draft submission documents referencing any applicable legislation and policy supporting your case. Whenever possible, we include Tribunal jurisprudence where the Workplace Safety & Insurance Appeals Tribunal (WSIAT) has rendered positive decisions for the worker in similar cases as yours; we also reference Tribunal Medical Discussions Papers that deal with similar medical issues. These are documents that the Tribunal has requested from experts with expertise in various medical conditions to help the Tribunal make decisions.     

Legal Referral to Preferred Legal Provider 

In some cases, a formal appeal is the more appropriate course of action. We will be able to identify that quickly and, with your permission, will proceed with a Legal Referral to one of our experienced lawyers or paralegals on our Preferred Legal Provider Network so that they can proceed on your behalf. There are many benefits to having one of our PLP handle your case. We have already done the vetting for you and know they are the best at what they do. Secondly and equally important, they provide our members with preferred rates to handle their appeals. This means you get to keep more of your settlement in your pocket!


Risk Free Guarantee

We have a two-tiered fee structure as illustrated below.

Tier 1 - Case Audit & Prepared Submissions 

  1. A one-time fee of $300 is charged to perform the audit and prepare submission documents to address the issues identified in the audit.

  2. If you agree to proceed with the submission documents we prepare for you, there is an additional fee of $300. Bringing your total cost to $600

  3. If we cannot identify any actionable issues in your case, we will refund you the initial $300 payment, bringing your total cost to zero.

  4. If we cannot identify any actionable issues when we do the audit, but you would like us to remain involved in your case to provide guidance and support and to help you make informed decisions, the additional fee is $300. Keeping your total cost at $600

  5. If we determine that the most appropriate course of action in your case is to make a legal referral to one of our Preferred Legal Providers, we will proceed with the referral and there will be no additional fee beyond the initial $300.


Tier 2 - Contingency Fee Agreement

Our Contingency Fee Agreement covers the second-tier fees. A Contingency Fee Agreement means that any additional fees will apply only if we successfully gain additional benefits for you. If we are unsuccessful, you won't be charged any extra fee. You can view our agreement below. You will note that our fee for securing benefits and services for you through reconsideration submissions and without a formal appeal is significantly less than what it would be if a formal appeal were required.
