The following provides a step-by-step explanation of how our All-In-One Risk Free Guarantee works.
Case Review
Should you decide to activate your membership by following the process below, we will conduct an in-depth review of your case, including your WSIB claim file, to identify any issues not correctly handled by the WSIB and benefits that the WSIB did not consider in your claim. We also identify potential entitlement to benefits under other disability insurance plans through our Financial Evaluation & Income Estimate (see below for further details) to help you receive the maximum benefits you're entitled to.
Prepared Submissions
We know that appeals can take a long time, sometimes even years. We avoid that whenever possible. We help draft a formal request for reconsideration of decisions we believe were not appropriate by WSIB decision-makers, including requests for benefits and services that the WSIB failed to address in your claim. These documents are not just a request for benefits or for the WSIB to review what they had already reviewed when making the initial decision, without the kind of support that could result in a favourable decision. The draft submissions will reference any applicable legislation and policies supporting your case. Whenever possible, we include Tribunal jurisprudence where the Workplace Safety & Insurance Appeals Tribunal (WSIAT) has rendered positive decisions for workers in similar cases to yours; we also reference Tribunal Medical Discussions Papers that address similar medical issues. These are documents that the Tribunal has requested from experts with expertise in various medical conditions to help the Tribunal make decisions.
Legal Referral to Preferred Legal Provider
In some cases, a formal appeal is the more appropriate course of action. We will be able to identify that quickly and, with your permission, will proceed with a Legal Referral to one of our experienced lawyers or paralegals on our Preferred Legal Provider Network (PLPN) so that they can proceed on your behalf. Lawyers and paralegals on our network are licensed under the Law Society of Ontario. There are many benefits to having one of our PLPs handle your case. We have already done the vetting for you and know they are the best at what they do. Secondly and equally important, they provide our members with preferred rates to handle their appeals. This means you get to keep more of your settlement in your pocket!
Financial Evaluation & Income Estimate
Many factors can affect what your claim is worth and your monthly income, both from the WSIB as well as other insurance plans. Some of which have nothing to do with the WSIB but can be impacted by your claim and your inability to work, whether temporary or permanent.
Some of these factors are: other insurance or disability plans such as Canada Pension Disability (CPPD), Long Term Disability (LTD), Ontario Disability Support Program (ODSP), retirement plan, Union plan, as well as other financial relief plans most people aren't aware of that can have a positive impact on your finances.
This is a valuable tool for budget planning and understanding how to maximize your income from different sources.
We help prepare the necessary documents to qualify for any applicable plan or insurance benefits.
All-In-One Membership Risk Free Guarantee
We have a two-tiered fee structure as illustrated below.
Tier 1 - Membership Fee - $600
- A one-time fee of $600 or 2 two payments of $300 is charged to perform the Case Review and prepare submission documents to address the issues identified in the Case Review.
- If we cannot identify any actionable issues in your case, we will refund you the initial $600 payment, bringing your total cost to zero.
- If we determine that the most appropriate course of action in your case is to make a legal referral to one of our Preferred Legal Providers, with your permission, we will proceed with the referral. Your membership with WSIB Settlements will remain active, and any additional fees are covered in the Contingency Fee Agreement.
Tier 2 - Contingency Fee Agreement
Our Contingency Fee Agreement covers the second-tier fees. A Contingency Fee Agreement means that any additional fees will apply only if additional benefits are allowed by the WSIB as a result of our support through your membership. If no benefits are allowed, you won't be charged any extra fee. You can view our agreement below. You will note that our fee for securing benefits and services for you through reconsideration submissions we helped prepare for you, without requiring a formal appeal, is significantly less than what it would be if a formal appeal were necessary.
